DENNIS TWP. -- State Police confirm one person is dead after cutting down a tree at a private residence in Dennis Township.

Around 2:45 Tuesday on the 200 block of Kings highway, a father came home to find his 61-year old son dead under a 50-foot oak tree branch in their front yard.

tree when the limb fell on top of him.

"Just a shock, sudden shock. His father was at the eye doctors, he lives with his father. The father came home and saw the limb on top of him. So he called 911 and now you can see all of this" says Carl Marino, Brother in law, Frank Smith.

State police along with the local fire company and rescue squad all arrived on the scene to help Frank Smith, but it was too late, Smith was pronounced dead on the scene.

Marino says Frank was cutting limbs away from power lines, which was nothing but typical work for him.

"He liked to cut trees down, just did things around the house, worked on his cars and was happy with doing that. He retired from state school in Woodbine" says Marino.

Marino says Smith was living at home to take care of his father.

"Father is a World War II Veteran. He is pretty broken up. Frank did live int hat house to take care of pop and help pop out" says Marino.

The freshly cut limb and ladder were all taken from the scene by the fire company to be examined.

Police are continuing their investigation into this freak accident.
